How long do pest control application records have to be kept in New York?
At least three years, under Environmental Conservation Law 33-1205.
A record of every visit showing what was applied, where, when and for what pest, because New York already requires commercial applicators to log those details for each application.
Environmental Conservation Law 33-1205 requires every commercial applicator to keep records of each pesticide application: the EPA registration number, the product name, the quantity used, the date, and the address with zip code, plus dosage rates, methods of application and target organisms. Those records must be kept at least three years. NYSDEC guidance also requires commercial applicators to file an annual report with the DEC by February 1 for the prior year.
The applicator already has to write this down. The question is whether you have a copy. When a tenant complains or an inspector asks what has been done, the manager with every visit record in the building file has the answer in hand. The one without it is making phone calls.
Keep records by building, so a stack of units that keeps calling shows up on paper before it turns into a dispute.
